Terms of Service

1. Acceptance

By creating an account, uploading source material, purchasing a manuscript, or using SpokenPrint (the "Service"), you agree to these Terms of Service and the policies linked from them.

2. Acceptable Use

You may use SpokenPrint to transform spoken content you own, are authorized to use, or have a valid license to use. You may not upload content that infringes others' rights, violates someone's privacy or publicity rights, contains instructions for illegal activity, depicts minors in sexual content, or incites violence against specific groups. See our Acceptable Use Policy for the full list of permitted and prohibited uses.

3. Your Content, Rights, and Ownership

You retain ownership of the source material you submit and of the manuscripts and exports produced for you. SpokenPrint does not claim copyright ownership in your finished work.

You grant SpokenPrint the limited rights needed to provide the Service: to host, process, analyze, transform, display, store, export, troubleshoot, and support your project; to create rights and AI-disclosure records; and to enforce these Terms. This limited license ends when it is no longer needed for those purposes, subject to our retention policy and legal, security, payment, and rights-record obligations.

By submitting source material, you represent that you hold the rights to do so or have valid authorization. You are responsible for speaker consent, third-party material, attribution, and publication clearances. You agree to indemnify SpokenPrint against claims arising from content you submit without authorization or publish without required review.

4. AI Processing and Publication Responsibility

SpokenPrint uses AI models and related tools to analyze source material, draft manuscripts, suggest edits, and prepare export materials. The manuscript is a human-directed work: you approve structure, review generated sections, accept or revise edits, and decide what to publish.

Export materials may include AI-use disclosure language intended to help with publishing platforms such as Amazon KDP, IngramSpark, or Apple Books. Platform rules can change, and you are responsible for making sure any disclosure remains accurate for the version you publish.

Copyright registrability is not guaranteed. SpokenPrint does not guarantee that any specific output can be registered for copyright. The U.S. Copyright Office evaluates AI-assisted works case by case, and registrability depends on the human authorship in your project.

You are responsible for reviewing, editing, fact-checking, and clearing the final output before publication. SpokenPrint is not a legal, tax, publishing, or professional-advice service.

5. Payment and Refunds

Manuscript purchases are one-time project purchases, with pricing shown before checkout. Refund eligibility depends on timing, paid-content access, export activity, payment status, and the issue reported. Requests made within 48 hours of payment with less than 5% of paid content accessed are generally eligible for a full refund. Requests made within 7 days with less than 25% accessed and no exports completed may also be eligible. Beyond 7 days, refunds are reviewed case by case.

Manuscripts and exports are digital goods. Once you have exported a manuscript, refunds for that project are limited and handled case by case, because you have received and downloaded the finished work. Payments, refunds, stored payment methods, and identity checks are handled by Stripe. We do not store full card numbers. Any one-time Hugo Credits purchase must be explicitly authorized by you in the Service.

6. Service Availability

We aim for reliable service, but we make no uptime or uninterrupted-processing guarantees. Generation, transcription, payments, email, storage, and authentication may depend on third-party providers. Jobs may be queued, retried, delayed, or unavailable during maintenance, abuse review, rights review, provider outages, or security events.

7. Account Termination

We may suspend or terminate accounts or projects that violate these Terms, the Acceptable Use Policy, or the Copyright & DMCA Policy, with notice except where immediate action is required to address rights violations, fraud, security risk, legal obligations, or other harm.

8. Warranty Disclaimer, Liability, and Governing Law

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that output is accurate, error-free, suitable for publication, or accepted by any publishing platform.

To the maximum extent permitted by law, SpokenPrint's liability for any claim is limited to the amount you paid for the affected project.

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Summit County, Ohio, and you consent to their jurisdiction.

9. Changes

We may update these Terms. If a change materially affects your rights or obligations, we will provide notice before the change takes effect when required by law or when reasonably practicable.
